The Hirer shall indemnify and keep indemnified and save harmless the Owner and the Owner’s servants and agents from all damages, suits, actions or otherwise.
The Owner shall not be liable to the Hirer or the Hirer’s servants or agents for any damages, suits, actions, claims and demands of every description whatsoever and howsoever arising either directly or indirectly from representations warranties, terms and conditions express or implied (except in so far as statutory conditions and warranties cannot be excluded under Part V Division 2A of the Trade Practices Act (1974) or relevant State legislation), use, maintenance, transport, operation of the goods or otherwise and whether resulting from the negligence of the Owner, Its servants or agents or otherwise.
The Owner shall not be liable for any failure to perform caused by weather, lack of power/water connections, or other causes beyond its control.
Conditions which prevent satisfactory operation of equipment do not relieve Hirer of his responsibility for hire charges.
If due to mechanical breakdown, weather, road or any other operational condition, equipment cannot be delivered on time, any refund will be at the absolute discretion of Owner.
If due to mechanical breakdown or any other operational condition, The Owner may arrange for similar type facilities from elsewhere to replace quoted equipment.
Hirer assumes all responsibility for equipment when out of the possession of the Owner and promises to return such equipment to the Owner in as good condition as it was at the effective date of this agreement, fair wear and tear accepted.
Hirer is responsible for cost of replacement and repairs due to fire, theft, carelessness, accidental damage, vandalism or riot. (ordinary use and wear accepted)
The Owner may close facility or require a Security Guard to be present at anytime if damage and vandalism is carried out by patrons of the event
Price quoted includes facility cleaning and restocking of supplies. (Not Applicable to portables)
If the event finishes earlier than the quoted dates, any refund or price reduction will be at the sole discretion of the Owner.
Signed agreement and 10% deposit is required to confirm booking.
Final payment for the hire is due and payable on the last day of the event.
Proof of Insurance for property damage,
Electric supply and connection (refer to unit specifications),
Water connection point (refer to unit specifications),
Arranging and payment for waste removal and pumping.
If more than one sewerage disposal is required, an additional $55.00 per unit per disposal will apply (portable toilets only).
Cancellation between: 10 – 28 days before event – deposit forfeited, Less than 10 days – full cost (if facilities have been relocated, otherwise deposit forfeited)
